Summary Mining companies after the Gold Rush depended heavily on foreign expertise, and yet historians of mining have glorified ‘German engineering’ in America. The application of German technology in America was fraught with difficulties, and most advances were micro- rather than macro-innovations, such as Philip Deidesheimer's famous square-set timbering on the Comstock Lode. The problem began at German mining schools, such as the Freiberg Mining Academy, where Americans like Louis and Henry Janin, while they acquired advanced training and adopted an (...) engineering ethos, struggled to learn about Mexican and American mining. Having complemented their course of study to remedy this deficiency, the brothers returned to the US intending to modernize mining on the frontier. Louis attempted the ‘Freiberg Process’ of amalgamation on the Comstock Lode, but locally developed methods proved more feasible, and the experiment failed. He came to apply his training rather toward the micro-level problem of how to reprocess amalgamation waste heaps. (shrink)

A conflict within the community of those investigating business ethics is whether decision makers are motivated by an ethics of justice or an ethics of caring. The proposition put forward in this paper is that ethical orientations are strongly related to cultural backgrounds. Specifically, Hofstede's cultural stereotyping using his masculine-feminine dimension may well match a culture's reliance on justice or caring when decisions are made. A study of college graduates from six countries showed that Hofstede's dimension was remarkably accurate in (...) predicating a justice or caring orientation for decision makers from five of the six countries. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

The rule-following debate, in its concern with the metaphysics and epistemology of linguistic meaning and mental content, goes to the heart of the most fundamental questions of contemporary philosophy of mind and language. The genesis of the Greek prose romance is still in large part shrouded in darkness, in spite of the researches of Erwin Rohde, one of the greatest scholars of the last generation. The reasons are evident; the material at our disposal is far too scanty, the loss of early specimens of this literary form is far too great to allow of a flawless reconstruction of the history of the Greek romance. The same lacunae have also prevented us from obtaining as (...) complete an insight into the sources of the extant romances as would be desirable. Rohde conjectured that the genre was the result of a skilful combination of mythological narrative and adventure novel; Warren thought that the Greek prose romance had about the same origin and took the same development as the old French prose romance—that is, it developed out of the epic. At all times scholars have been aware of the fact that the great role which love plays in the Greek romance has a parallel in the tragedies of Euripides, who may be considered the first tragic poet to introduce the love theme on the stage. But so far as I am aware, it has not been pointed out that Euripides was drawn upon for whole episodes in order to enrich the plot of the novel. Yet such seems to have been the case for one of the best-known passages of the Apollonius Romance, as I shall endeavour to show in the following pages. (shrink)

While many philosophers of law spend their careers exploring the warrens of a single neighbourhood within the sprawling cities of the philosophy of law, Larry Alexander has rambled widely, exploring obscure alleyways and dense downtowns, making significant and influential contributions along the way. The volume under review, a Festschrift in his honour, draws from a correspondingly wide range of areas of scholarship, from the philosophy of criminal law and punishment to constitutional law, from analytic jurisprudence to moral philosophy. Thus, (...) given the breadth and depth of Alexander’s influence, this volume provides a partial snapshot of some of the major preoccupations of American legal theory over the last few decades. In light of the breadth of topics considered, as well as its substantial length—the book includes twenty‐two papers, an introduction by Heidi Hurd, the editor, and a substantial reply by Alexander—my discussion is selective and evocative, rather than comprehensive and detailed. All the more so, as many of the papers are important contributions in their own right that merit close scrutiny. (shrink)

We face reality presented with the data of conscious experience and nothing else. The project of early modern philosophy was to build a complete theory of the world from this starting point, with no cheating. Crucial to this starting point is the data of conscious sensory experience – sense data. Attempts to avoid this project often argue that the very idea of sense data is confused. But the sense-data way of talking, the sense-data language, can be freed from every blemish (...) using ideas from contemporary metaontology. We can adopt a sense-data framework that vindicates the traditional claims of sense-data theories and leads to plausible theories of perception and color. We can, we should, and in a sense, we must. Yet when we do, we face the traditional problem of external world skepticism, head-on. The real challenge of skepticism is forced upon us; it cannot honestly be avoided using externalist tricks, burden of proof shifting, or other razzle dazzle. But the challenge can be met: we are rational to posit the external world as the best explanation of the many synchronic and diachronic patterns over our sense-data. This paper argues for all of these points and ends with a plea for analytic empiricism – a traditional sense-data version of empiricism that uses all of the tools of analytic philosophy while avoiding the more questionable doctrines of the Vienna Circle (phenomenalism, verificationism). Analytic empiricism is our last best hope for completing the great philosophical project of early modern philosophy. (shrink)

Once upon a time, logical conventionalism was the most popular philosophical theory of logic. It was heavily favored by empiricists, logical positivists, and naturalists. According to logical conventionalism, linguistic conventions explain logical truth, validity, and modality. And conventions themselves are merely syntactic rules of language use, including inference rules. Logical conventionalism promised to eliminate mystery from the philosophy of logic by showing that both the metaphysics and epistemology of logic fit into a scientific picture of reality. For naturalists of all (...) stripes, this was paradise. Alas, paradise was lost. By the end of the twentieth century, logical conventionalism had been almost universally abandoned. But more recently, it has been revitalized. This chapter provides an overview of logical conventionalism and its history, clears away misunderstandings, and briefly responds to both the canonical objections to conventionalism (from Quine, Dummett, Boghossian, and many others) as well as new objections (from Field and Golan). I develop an expressivist account of verbal disagreements as practical disagreements over how to use words rather than factual disagreements over what words actually mean. This account enjoys several advantages over others in the literature: it can be implemented in a neo-Stalnakerian possible worlds framework; it accounts for cases where speakers are undecided on how exactly to interpret an expression; it avoids appeals to fraught notions like subject matter, charitable interpretation, and joint-carving; and it naturally extends to an analysis of (...) metalinguistic negotiations. It assesses the lived experiences, working lives, health and cultural perspectives of residents and key stakeholders in the wake of serious de-industralisation in the region. The narrative is embedded within the long-term industrial history of Stockton: an area once dominated by steel, coal and chemical industries. A common objection to the very idea of conceptual engineering is the topic continuity problem: whenever one tries to “reengineer” a concept, one only shifts attention away from one concept to another. Put differently, there is no such thing as conceptual revision: there’s only conceptual replacement. Here, I show that topic continuity is compatible with conceptual replacement. Whether the topic is preserved in an act of conceptual replacement simply depends on what is being replaced (a conceptual tool or a conceptual (...) role) and what the topic under discussion is. Thus, the topic continuity problem only arises from a failure to specify these two things. (shrink)

As CSR reporting becomes more commonplace, the theoretical and empirical analysis of this type of reporting has matured and both academics and practitioners have begun to explore the possibility of having CSR disclosures assured. This paper makes an important contribution by synthesising the findings on emerging forms of CSR assurance practice. It summarises the ground covered to date and provides a comprehensive (...) review of the literature on the characterises, use and limitations of CSR assurance services. It develops a conceptual model which distinguishes between determinants of CSR assurance at the national- and firm-level and shows how the nature of assurance services, a company’s reporting infrastructure and current technologies of assurance enable or constrain the benefits of having CSR disclosures assured. Multiple states are at risk of becoming uninhabitable due to climate change, forcing their populations to flee. While the 1951 Refugee Convention provides the gold standard of international protection, it is only applied to a limited subset of people fleeing their countries, those who suffer persecution, which most people fleeing climate change cannot establish. While many journalists and non-lawyers freely use the term “climate refugees,” governments, and courts, as well as UNHCR and many refugee experts, have excluded most climate refugees (...) from the Convention as a matter of legal interpretation. In our 2015 paper, “Unable to Return in the 1951 Refugee Convention: Stateless Refugees and Climate Change”, we sought to reopen the debate on “climate refugees” by arguing that some climate refugees qualify under the 1951 Convention as it is currently written (even if they are not persecuted): those who are stateless and are unable to return to their country of origin because climate change has rendered it uninhabitable. Our interpretation, however, has been rejected by Goodwin-Gill and McAdam (2021) and by Foster and Lambert (2019), which explicitly responds to our paper. Here, we address and respond to their arguments, and develop a new supplementary one, drawing on the principle of systemic integration, as enshrined in Article 31(3)(c) of the Vienna Convention on the Law of Treaties. This book provides a comprehensive guide to the conceptual methodological, and epistemological problems of biology, and treats in depth the major developments in molecular biology and evolutionary theory that have transformed both biology and its philosophy in recent decades. At the same time the work is a sustained argument for a particular philosophy of biology that unifies disparate issues and offers a framework for expectations about the future directions of the life sciences. The argument explores differences between autonomist and anti-autonomist (...) views of biology. The result is a vindication of reductionism, but one that is unexpectedly hollow. For it leaves the exponents of the autonomy of biology from physical science with as much as their view of biology really requires - and rather more than the reductionist might comfortably concede. Professor Rosenberg shows how the problems of the philosophy of biology are interconnected and how their solutions are interdependent, However, this book focuses more on the direct concerns of biologists, rather than the traditional agenda of philosophers' problems about biology. This departure from earlier books on the subject results both in greater understanding and relevance of the philosophy of science to biology as a whole. (shrink)

Call a term ‘pseudo-singular’ if it is syntactically singular but semantically plural. ‘The pair who wrote Principia’ is a good example, standing as it does for the two individuals, Whitehead and Russell. In this journal (2021), Eric Snyder and Stewart Shapiro launched an attack on the idea, calling it ‘linguistically and logically untenable.’ In this reply we rebut every one of their criticisms.

Kant’s accounts of the Highest Good and the moral argument for God and immortality are central features of his philosophy. But both involve lingering puzzles. In this entry, we first explore what the Highest Good is for Kant and the role it plays in a complete account of ethical life. We then focus on whether the Highest Good involves individuals only, or whether it also connects with Kant’s doctrines about the moral progress of the species. In this paper we discuss how Causal Decision Theory should be modified to handle a class of problematic cases involving deterministic laws. Causal Decision Theory, as it stands, is problematically biased against your endorsing deterministic propositions (for example it tells you to deny Newtonian physics, regardless of how confident you are of its truth). Our response is that this is not a problem for Causal Decision Theory per se, but arises because of the standard method for assessing the truth of (...) certain counterfactuals. The truth of deterministic laws is `modally fragile' on the standard semantics for counterfactuals: if determinism is true and you were to do otherwise, the laws would be different. We provide two ways of avoiding this problem: 1) supplement the standard semantics for counterfactuals with impossible worlds, or 2) introduce rigid designators into the description of problematic decision situations. We argue that both of these approaches are well-motivated and can be readily incorporated into Lewisian Causal Decision Theory. (shrink)

Kant and Fichte developed the concept of a worldview as a way of reflecting on experience as a whole. But what does it mean to form a worldview? And what role did it play in the German Idealist tradition? This paper seeks to answer these questions through a detailed analysis of the form of a philosophical worldview and its historical portent, both of which remain unexplored in the literature. The dearth of attention is partially to blame on Kant’s desultory development (...) of it, as well as its place in Fichte’s understudied lectures on religion. In this paper, I first reconstruct Kant’s conception as the starting point and then trace it to Fichte who went on to evolve it further. Fichte endorses the basic conceptual shape pioneered by Kant, namely, a reflective process of positing an idea and then checking the coherence of necessary judgments relative to it. However, Fichte came to realize that its philosophical function needed expanding. Beyond recognizing the possibility for alternative worldviews, Fichte further fleshed out how worldview creation could lead to human flourishing. The common feature between both thinkers is that the formation of a worldview aims to turn philosophy into a life-orienting exercise. (shrink)

The theological problems of the ethics of love for one’s neighbour are considered: the impossibility of literal fulfilment of the commandments and doubtfulness of their applicability in public and state life. One of the approaches to solving these problems is based on the principle of reverence for life, proposed by Albert Schweitzer and expressing, in his opinion, the essence of love for one’s neighbour. Subsequently, this principle was borrowed by Karl Barth, who gave it a theological justification. Although Barth’s texts (...) on reverence for life are well known, some fundamental issues are still insufficiently investigated. Why did Barth claim that reverence for life does not fully express the essence of Christian ethics? What is the fundamental difference between the Barth’s and Schweitzer’s approaches to Christian ethics? How was this difference of approaches manifested in the practical recommendations? The article provides a comparative analysis of Barth’s and Schweitzer’s ethics and answers the above questions. (shrink)

Pattern-based reasons are reasons for action deriving not from the features of our own actions, but from the features of the larger patterns of action in which we might be participating. These reasons might relate to the patterns of action that will actually be carried out, or they might relate to merely hypothetical patterns. In past work, I have argued that accepting merely hypothetical pattern-based reasons, together with a plausible account of how to weigh these reasons, can lead to disastrous (...) consequences. However, in this article, I argue that this problem is not limited to hypothetical pattern-based reasons: it turns out that there are analogous issues for reasons deriving from actual patterns. I then suggest that we can avoid this problem by adopting a different account of the weight of pattern-based reasons. (shrink)

We give a novel approach to proving soundness and completeness for a logic (henceforth: the object-logic) that bypasses truth-in-a-model to work directly with validity. Instead of working with specific worlds in specific models, we reason with eigenworlds (i.e., generic representatives of worlds) in an arbitrary model. This reasoning is captured by a sequent calculus for a _meta_-logic (in this case, first-order classical logic) expressive enough to capture the semantics of the object-logic. Essentially, one has a calculus of validity for the (...) object-logic. The method proceeds through the perspective of reductive logic (as opposed to the more traditional paradigm of deductive logic), using the space of reductions as a medium for showing the behavioural equivalence of reduction in the sequent calculus for the object-logic and in the validity calculus. Rather than study the technique in general, we illustrate it for the logic of Bunched Implications (BI), thus IPL and MILL (without negation) are also treated. Intuitively, BI is the free combination of intuitionistic propositional logic and multiplicative intuitionistic linear logic, which renders its meta-theory is quite complex. The literature on BI contains many similar, but ultimately different, algebraic structures and satisfaction relations that either capture only fragments of the logic (albeit large ones) or have complex clauses for certain connectives (e.g., Beth’s clause for disjunction instead of Kripke’s). It is this complexity that motivates us to use BI as a case-study for this approach to semantics. (shrink)

On this basis it then goes on to describe and defend a naturalized, functionalist account of group knowledge. It then contrasts this with Jennifer Lackey's (2021) account of the epistemological status of groups.

This thesis develops a detailed account of the emergence of for all practical purposes continuous, quasi-classical world histories from the discontinuous, stochastic micro dynamics of Minimal Bohmian Mechanics (MBM). MBM is a non-relativistic quantum theory. It results from excising the guiding equation from standard Bohmian Mechanics (BM) and reinterpreting the quantum equilibrium hypothesis as a stochastic guidance law for the random actualization of configurations of Bohmian particles. On MBM, there are no continuous trajectories linking up individual configurations. Instead, individual configurations (...) are actualized independently of each other, carving out the decoherence-induced branching structure of the universal wave function. Yet, by contrast to the Everett interpretation, branches of the universal wave function are not actualized in parallel, i.e. all at the same time. Rather, world branches, on MBM, are actualized sequentially. -/- For an introduction to MBM, the transition from BM to MBM is described, and their empirical equivalence is established. I present the conditions under which MBM can be classified as a primitive ontology (PO) theory, regarded as crucial for the acceptance of a theory as Bohmian by many proponents of BM. While rendering MBM compatible with the PO approach, it must not fall prey to the problem of communication, arising from the two-space reading of BM. -/- The issue of temporal solipsism, identified by Bell as a serious problem for his “Everett (?) theory” – the historic predecessor of MBM – is discussed. I argue that Barbour’s time capsule approach does not provide a satisfactory solution. In particular, his adopting a more than minimal psychophysical parallelism between brain processes and experience of macroscopic change is argued to be reasonable in light of our current best neuroscience, yet problematic for theories relying solely on time capsules, understood as highly structured, individual, internally static configurations. As a solution, I introduce worlds, and world histories, as key concepts in providing a link between MBM’s micro dynamics and macroscopic phenomena. Worlds, other than time capsules, are coarse-grained regions in phase- or configuration space, defined as sets of possible micro states satisfying a relation of sufficient similarity from a macroscopic perspective, with respect to a given micro state. Hence, worlds may overlap. -/- I argue that worlds thus construed are a reasonable option for replacing the disjoint macro regions of phase space, resulting from the usual way of partitioning phase space in the standard framework of Boltzmannian statistical mechanics. This move solves the issue of discontinuous change of macro variables upon the micro state crossing the boundary between different macro regions. -/- I adapt this move for MBM’s discontinuous micro dynamics in configuration space. Issues revolving around the microscopic-macroscopic distinction, particle identity, impenetrability and haecceity in light of the desideratum of particle number conservation, etc., are discussed. I provide a detailed explanation of how overlapping worlds in MBM form world histories, thereby linking up macroscopically distinct worlds. Thus, the problem of temporal solipsism is resolved in a way that is compatible with a more than minimal psychophysical parallelism. (shrink)

The Covid-19 crisis has clarified the demand for an ultra-brief single-session, online, theory-led, empirically supported, psychological intervention for managing stress and improving well-being, especially for people within organizational settings. We designed and delivered “4Ds for Dealing with Distress” during the crisis to address this need. 4Ds unifies a spectrum of familiar emotion regulation strategies, resilience exercises, and problem-solving approaches using perceptual control theory and distils them into a simple four-component rubric. In essence, the aim is to reduce distress and restore (...) wellbeing, both in the present moment through current actions, and through expressing longer-term goal conflicts to discover new perspectives that arise spontaneously after sufficient time and consideration. The intervention is user-led in that it draws on users’ own idiosyncratic and pre-existing experiences, knowledge, skills and resources to help them apply an approach, or combination of approaches, that are proportionate and timed to the nature and context of the stress they are experiencing. In this article we review the empirical basis of the approach within experimental, social, biological and clinical psychology, illustrate the novel and time-efficient delivery format, describe its relevance to sports and exercise, summarise feedback from the recipients of the intervention to date, and describe the directions for future evaluation. Rosenberg applies current thinking in philosophy of science to neoclassical economics in order to assess its claims to scientific standing. Building on Nozick's invariantism about objectivity, I propose to define scientific objectivity in terms of counterfactual independence. I will argue that such a counterfactual independence account is (a) able to overcome the decisive shortcomings of Nozick's original invariantism and (b) applicable to three paradigmatic kinds of scientific objectivity (that is, objectivity as replication, objectivity as robustness, and objectivity as Mertonian universalism).

Bayesian epistemology has struggled with the problem of regularity: how to deal with events that in classical probability have zero probability. While the cases most discussed in the literature, such as infinite sequences of coin tosses or continuous spinners, do not actually come up in scientific practice, there are cases that do come up in science. I shall argue that these cases can be resolved without leaving the realm of classical probability, by choosing a probability measure that preserves “enough” regularity. (...) On the other hand, there are types of moral actions in which no such intellectual difficulty exists, where the right thing to do is very clear, yet hesitation (...) or even rejection of the moral law arises because to persist in virtuous living seems too difficult. For example, as St. Augustine writes in his Confessions: "Lord, give me chastity, but not yet." Augustine is not unclear about what he ought to do, yet he perceives that there remains a real gap between the truth of the moral law and his own ability to live virtuously what love demands.Christian moral theology reveals that this "gap" is not at all unusual, nor even surprising. Given original sin and its effects on the human heart, man stands in genuine need of a redeemer. For this reason, the task of moral theology today cannot involve merely presenting the truth of the moral law, important as it is; it must empower the human heart to live it. I argue that, to inspire and transform hearts, moral theology must be presented within the biblical story of salvation and lead to a personal encounter with Christ. Indeed, this is precisely what the Second Vatican Council called for when it insisted that theologians take "special care" in the renewal of moral theology. The Council fathers insisted that, in its presentation, moral theology needs to be more deeply animated by Scripture, to integrate with dogmatic theology, and most of all, to find its place within the mystery of Christ.1 [End Page 333]In this paper, I would like to demonstrate how Pope John Paul II's insights in his 1993 encyclical Veritatis Splendor (VS) can aid in a pastoral approach to morally difficult situations.2 It is no secret that he wrote this encyclical to address the widespread dissent among Catholic moral theologians who dissented from the magisterium on difficult moral issues such as contraception, abortion, divorce, in vitro fertilization, and homosexuality by attempting to reinvent the foundational principles of morality, which led to a whole host of errors. Yet, even though one can prove demonstratively the truth of the moral law, there still remains the pastoral question: "But what am I to do, if remaining faithful is very difficult?" "What can I do when I cannot seem to rise to what love demands, or I am afraid of what love will cost me?" In this paper, I will share three key insights from his work that lead to an effective pastoral response: (1) to rediscover the purpose of living a moral life, (2) to recognize the missing human good in difficult circumstances, (3) to receive the fullness of sacramental grace. The paper examines two of the most influential approaches to the problem of the justification of perceptual knowledge: representationalism and direct realism, taken in a version of epistemological disjunctivism. The problem itself can be represented as the need to demonstrate that there is a logical connection between a statement about the perception of a certain fact, p, and a statement about the knowledge of p. The article notes that both approaches face the problem of “the silence of the senses.” This (...) problem was pointed out by Ch.Travis, who tried to show that the content of sensory experience is not propositional; senses themselves do not tell us what fact we are dealing with when perceptually interacting with the world. The first part of the article reconstructs the argument from looks that Travis proposed to criticize representationalism. This part demonstrates that we cannot accept representationalism as an approach in the philosophy of perception that successfully overcomes the shortcomings of sense data theory. The main drawback of this theory was its adherence to the myth of the given—the idea that in perceptual experience we are dealing with non-propositional, non-conceptual “raw” data. The second part of the paper notes that Travis’s argument can also be directed against such a version of direct realism as epistemological disjunctivism, since according to representatives of this theory, the content of veridical perceptual experience, being identical with the perceived state of affairs, is propositional. This part also analyzes the response to Travis from such a representative of this theory as J.McDowell. While McDowell rejects propositionalism, he nevertheless insists that the content of perceptual experience must be regarded as conceptual. It allows us to avoid the myth of the given. In conclusion, criticism of McDowell’s approach from the phenomenological position taken by H.Dreyfus is discussed, and it is noted that McDowell’s conceptualism is quite compatible with both phenomenology and enactivism. The enactivist understanding of perception that we find in McDowell leads us to accept the enactivist account of perceptual knowledge, where the foundation of knowledge is action, i.e. something epistemically groundless. The recent literature abounds with accounts of the semantics and pragmatics of so-called predicates of personal taste, i.e. predicates whose application is, in some sense or other, a subjective matter. Relativism and contextualism are the major types of theories. One crucial difference between these theories concerns how we should assess previous taste claims. Relativism predicts that we should assess them in the light of the taste standard governing the context of assessment. Contextualism predicts that we should assess them in the (...) light of the taste standard governing the context of use. We show in a range of experiments that neither prediction is correct. People have no clear preferences either way and which taste standard they choose in evaluating a previous taste claim crucially depends on whether they start out with a favorable attitude towards the object in question and then come to have an unfavorable attitude or vice versa. We suggest an account of the data in terms of what we call hybrid relativism. (shrink)
